Terms of Sale

1 ONLINE ORDERS

By placing an order with Tappers Artisan Spirits Ltd. (t/a Tappers Gin), you acknowledge that you have read, understood and agreed to these Terms of Sale. If you are unhappy with any aspect of these Terms then you should contact us at info@tappersgin.com before placing an order with us.

We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide during checkout. Our acceptance of your order brings into existence a legally binding contract between us.

We have taken care to describe and show items as accurately as possible but despite this, slight variations in items may occur. All prices include VAT (where applicable) at the current rates. The element of your order which relates to VAT will be clearly displayed for your information.

Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this website.

We may refuse at our discretion to accept an order:

1) Where we cannot obtain authorisation for your payment;

2) If there has been a pricing or product description error;

3) If you do not meet any eligibility criteria set out in our terms and conditions;

4) Where goods ordered by you are not available;

5) If we do not deliver to your area;

6) If we feel your order is being placed with the intention of bringing damage or disrepute to our brand – for example, if you are a competitor.

Where we do not accept your order but have processed your payment, we will refund your account with any amount deducted by us from your debit or credit card as soon as possible, but in any event within 30 days of your order. We will not be obliged to pay any additional amount as compensation for disappointment.

By placing an order with us you are confirming that you are over 18. We reserve the right to request proof of age and/or decline to fulfil your order. Orders cannot be dispatched until your age has been verified regardless of shipping option selected.

It is an offence to attempt to buy alcohol if you are under 18 years of age or to buy, or attempt to buy, alcohol for persons under the age of 18.

2 ITEMS AVAILABLE FOR PRE-ORDER

If you order a product which is highlighted as being available for “pre-order”, we will dispatch that item to you on the expected date of release which is listed on our website. Events beyond our control may delay dispatch – if such a situation arises, we will notify you as soon as possible and provide you with a revised estimated date of dispatch.

We will take payment for any item on pre-order as soon as you order it through our website but we will not pay you any interest in respect of the period between the date on which you place the order and the date on which we dispatch the item to you.

You may cancel an order for pre-order items at any time before the item is dispatched. If you choose to cancel the order, we will refund the full amount (including shipping costs).

You may also return an item to us after it has been dispatched to you in accordance with our normal shipping and returns policy.

4 COMPETITIONS

1) Entry is open to residents of the UK except for employees (and their families) of Tappers Artisan Spirits Ltd. and their agents, the suppliers of the prizes and any other companies associated with the competitions.

2) The entrant(s) must be aged 18 or over. Proof of identity and age may be required.

3) Use of a false name or address will result in disqualification.

4) Entries that are incomplete, illegible, indecipherable, or inaudible (if made by phone) will not be valid and deemed void.

5) All entries must be made directly by the person entering the competition.

6) Entries made online using methods generated by a script, macro or the use of automated devices will be void.

7) No responsibility can be accepted for entries lost, damaged or delayed in the post, or due to computer error in transit.

8) The prizes are as stated, are not transferable to another individual and no cash or other alternatives will be offered.

9) The winner(s) is (are) responsible for expenses and arrangements not specifically included in the prizes, including any necessary travel documents, passports and visas.

10) Prizes are subject to availability and the prize suppliers’ terms and conditions.

11) The promoters reserve the right to amend or alter the terms of competitions at any time and reject entries from entrants not entering into the spirit of the competition.

12) In the event of a prize being unavailable, the promoter reserves the right to offer an alternative prize of equal or greater value.

13) Unless stated otherwise the winner(s) will be drawn at random from all correct entries received by the closing date stated within the promotional material.

14) Reasonable efforts will be made to contact the winner(s). If the winner(s) cannot be contacted, or are unable to comply with these terms and conditions, the Promoter reserves the right to offer the prize to the next eligible entrant drawn at random, or in the event that the promotion is being judged the Promoter reserves the right to offer the prize to the runner(s)-up selected by the same judges.

15) Confirmation of the prize will be made in writing by email to the winner(s).

16) Failure to respond and/or provide an address for delivery, or failure to meet the eligibility requirements may result in forfeiture of the prize.

17) Where applicable, the decision of the judges is final based on the criteria set out in the promotion and no correspondence will be entered into over this decision.

18) Competitions may be modified or withdrawn at any time.

19) The provider of the prize is specified within the promotional material.

20) The Promoter is Tappers Artisan Spirits Ltd., Unit 9, Arrowe Commercial Park, Arrowe Brook Road, Wirral. CH49 1AB. Competitions by The Promoter are not associated with, endorsed by, sponsored by or administered by any other party including channels on which they may be publicised including but not limited to Facebook, Instagram, and Twitter, and these organisations have no responsibility to entrants or participants.

21) In the event of a discrepancy between these standard terms and conditions and the details in the promotional material (or any other terms and conditions provided/referred to at the time of entry), the details of the promotional material (and any other terms and conditions provided/referred to at the time of entry) shall prevail.

5 EVENTS AND TICKETS INCLUDING VIA THIRD-PARTY BOOKING SITES

1) Tickets you purchase are for the use of a named individual. Except as we may agree, you and your party must not re-sell or transfer (or seek to re-sell or transfer) the tickets in breach of the applicable terms. A breach of this condition will entitle us to cancel the tickets without prior notification, refund, compensation or liability.

2) To prevent fraud and protect you and us, we may carry out checks and/or you may be asked to provide additional information (such as a copy of a credit or debit card statement) after your booking so we can verify your purchase. If we suspect fraud we may cancel any order or tickets.

3) You must inform us of any change of address, contact phone number or email address, both before and after receipt of the tickets. Our preferred method to contact you is email, so you should take care to provide a current, valid email address and be aware that your email filter settings may treat our emails as spam or direct them to your junk folder.

4) An order for tickets is not complete until accepted by us. We try to ensure all prices are accurate but errors may occur. If we discover an error in the price of tickets you have ordered we will inform you as soon as possible and we may either cancel the order (in which case you will be refunded the ticket price and any booking, transaction or supplementary fees you have paid) or give you the option of confirming your order at the correct price.

5) We do not charge a booking fee for events that are booked direct on our website. If a booking is made via a third party then booking fees may apply - we have no control over this.

6) The event may be filmed or recorded. Buying a ticket affirms your consent to the filming and sound recording of yourself as a guest at the event. If you have any objection, please contact us at least 14 days prior to the event via the contact details on your ticket.

7) You will receive a confirmation of your booking within 24 hours of purchasing your tickets online. The confirmation will state the date, time and location of the event, together with the number of tickets purchased.

8) You must bring your confirmation document with you to the event, should confirmation of your booking be required.

9) Tickets (and any associated complimentary drinks or food) cannot be transferred, exchanged, or substituted, without agreement from us in writing.

10) Tickets cannot be refunded once purchased. Any refunds given are solely at the discretion of Tappers Artisan Spirits Ltd. and will not include third-party booking fees.

11) If the event is cancelled by us, we will provide you with a full refund in which case you will be refunded the ticket price and any booking, transaction or supplementary fees you have paid (if any). If the event is rescheduled, changed or moved, we will provide you with the option of either retaining or exchanging your tickets for the new date/location or alternatively claiming a refund.

12) Any refund will usually be paid using the same method you used to buy the tickets within 30 days after the original date of the event.

13) No refunds will be offered under any circumstances if you fail to comply with all terms and conditions applicable to the tickets, the venue or the event.

14) We accept no responsibility whatsoever for any loss or damage or injury of any kind suffered at or in connection with any event (including loss, damage or theft any personal property at an event).

15) Admission to an event is at all times subject to any terms, conditions or rules of the venue operator. If you breach those terms, conditions or rules then the venue operator may refuse admission or require you or other ticket holders to leave the venue.

16) You will need to comply with health and safety rules and any security requirements (including security searches for the safety of those attending the event). The venue will have the right to refuse admission or eject you in certain circumstances and these are likely to include if you are involved in abusive, threatening, drunken or other anti-social behaviour, or carry offensive weapons or illegal or prohibited substances or make unauthorised audio, video or photographic recordings. There may also be discretionary rules that restrict or prevent the admission of latecomers.

17) We will highlight any terms, conditions or rules relating to an event that we consider particularly significant, onerous or unusual. This will generally include age restrictions and ticket categories.

18) Before you finalise your booking, please read all the information that applies to the event and/or ticket. If you or any member of your party has particular dietary or access requirements please raise these within the notes section when booking and we will endeavour to address your query. This includes for each booking you make. There can be no guarantee that requirements can be met if notified at the event.

19) All visitors to the Distillery and Gallery Bar must be 18 years of age or older. Children and babies are not permitted in working production environments. There are no high chairs available.

20) Dogs are not permitted into the Distillery production environments but are welcome to the Gallery Bar and Distillery Shop. Water and treats are available for those visiting us with a dog. Dogs must be on a lead at all times and under control and must never be left unattended at any time.

6 TITLE OF GOODS

1) Title to Goods and Services shall remain with Us and shall not pass to You until the purchase price has been paid in full and received by Us. Until title to the Goods and/or Services passes:

a) We shall have authority to retake, sell or otherwise deal with and/or dispose of all or any part of the Goods/Services;

b) We and our agents and employees shall be entitled at any time and without the need to give notice enter upon any property upon which the Goods and/or Services or any part are stored, or upon which we reasonably believe them to be kept;

c) Irrespective of whether title to the Goods remains vested in Us, risk in the Goods/Services shall pass to You upon delivery.

7 FORCE MAJEURE

1) We shall not be liable to You in any manner or be deemed to be in breach of any contract with You because of delay in performing or any failure to perform any of the Suppliers obligations due to Force Majeure.

2) For the purposes of this clause, "Force Majeure" means any cause preventing Us from performing any or all of Our obligations which arises from any cause beyond Our reasonably control including without limitation:

a) Government actions, war or threat of war, acts of terrorism, national emergency, riot, civil disturbance, sabotage or requisition;

b) Act of God, fire, explosion, flood, epidemic or accident;

c) Labour disputes not including disputes involving the Suppliers work-force; or

d) Inability to obtain or delay in obtaining supplies of adequate or suitable material, fuel, parts, machinery or labour.
